Please read these terms before you place a booking or an order on this website. By booking or ordering any of our goods, you agree to be bound by them. Please review them from time to time so you are aware of any changes.

This English text is a translation provided for convenience. The Thai version is the operative one; if the two differ, the Thai text prevails.

Definitions
In these terms and conditions:
"Account" means an Elina Dress user account, which you may need to register on the website in order to place a booking or an order through it.
"Business day" means Monday to Sunday, excluding the public holidays the shop observes.
"Booking confirmation" means the email, message or LINE notification we send you stating that we have received and confirmed your booking under clause 5.2.
"Contract" means the rental agreement or contract of sale formed between you and us under these terms.
"Customer" or "you" means any person who places a booking or an order on this website or at the shop.
"Booking" means a gown rental reservation submitted by a customer to our website or through another of our contact channels.
"Rental period" means the period during which you are entitled to possess and use the gown, not counting the day you collect it or the day you return it.
"Deposit" means the damage security you place with us, refunded once you return the gown complete and in good condition under clause 8.
References to a "clause" are to a clause of these terms. Headings are for convenience only and do not affect interpretation.
Words in the singular include the plural and vice versa; words denoting any gender include every gender; and "person" includes a natural person, a juristic person, a company or a partnership.
"Including", "includes" and "such as" mean "including without limitation".

Eligibility
2.1 To place a booking or an order with Elina Dress you must be at least eighteen (18) years old. If you are under eighteen (18), you may use the service only where a parent, guardian or legal representative consents and enters into the contract on your behalf.
2.2 Because renting a gown places a valuable item temporarily in your possession, we reserve the right to inspect identification (such as a national ID card or passport) before handing the gown over. We hold that information in line with our privacy policy, and we do not retain your original documents.

Prohibited use
You must not misuse this website. You must not commit or encourage a criminal offence; transmit or distribute a virus, including but not limited to a Trojan horse, worm or logic bomb; post any content on the website that is malicious, technologically harmful, in breach of confidence, or offensive or obscene in any way; gain unauthorised access to any part of this service; use information here dishonestly; cause a nuisance to others; infringe the rights of others; send unsolicited advertising or promotional material; or attempt to affect the operation of any computer system of this website.
Breach of this clause may be an offence under the Computer Crime Act B.E. 2550 and its amendments. Where such a breach occurs, Elina Dress will report it to the relevant law-enforcement authorities and pursue legal action.

Application of these terms
4.1 These terms apply to every booking, every order and every contract we make to rent, sell and deliver goods. They constitute the entire agreement between you and Elina Dress and supersede any prior agreement between us. A waiver of any provision is effective only if made in writing and signed by an authorised representative of Elina Dress.
4.2 Any term you put forward yourself and we have not accepted in writing — whatever its form or timing, whether written, by email or oral — does not bind us, except as these terms expressly state.

Booking and rental terms
5.1 Registration
(a) To place a booking you may need to register with us by creating a user account on this website. You must give only accurate and truthful information, and you consent to our collecting it. You must tell us if the information you gave changes.
(b) You must not misuse this website by creating multiple user accounts.
(c) You are responsible for keeping your password confidential and for all activity that takes place under your account.
5.2 Formation of the contract
(a) The information and product details shown on this website are not an offer to sell or to rent, but an invitation to make an offer.
(b) To book a gown you must select the gown, state the date of use and the rental period, and follow the steps on the website or through the channel we specify.
(c) The rental contract is formed and binding once we have issued your booking confirmation and you have paid the deposit or rental fee set out in clause 5.4 in full.
(d) Bookings are held in order of payment. An enquiry, or pressing "book" without paying, does not hold the date.
(e) If your order contains more than one item, we may deliver it in several packages and on several occasions.
5.3 Sizing, fittings and alterations
(a) It is your responsibility to check that the size is right before you confirm the booking. The size chart shown on the website is approximate and may vary with the cut and the material of each gown.
(b) You may book a fitting at the shop in advance during opening hours, with at least 1 day’s notice. There is no fee for booking a fitting slot.
(c) We may offer minor alterations (taking in the waist, adjusting straps) at our discretion, and may charge for them. You must not cut, sew, alter, dye or modify a rented gown yourself or through anyone else under any circumstances. Doing so counts as damage to the gown under clause 8.
(d) We are not responsible where a gown does not fit because you gave inaccurate measurements, or because your proportions changed after the date you were measured or fitted.
5.4 Rental fee, deposit and payment
While we make every effort to keep the details, descriptions and prices shown on the website accurate, mistakes can happen. If we find an error in the price of goods you have booked or ordered, we will tell you as soon as possible and let you decide whether to confirm the order at the correct price or cancel it. If we cannot reach you, we treat the order as cancelled, and if you have already paid you receive a full refund.
(a) Prices are shown in Thai baht. The shop is not registered for VAT. Delivery charges (if any) are added to the rental fee and shown clearly in the "final total" before you confirm payment.
(b) Each gown rental comprises:
- The rental fee at the rate shown on the product page, for the standard rental period.
- The deposit (damage security), which we refund in full within 3 business days of receiving the gown back and confirming it is in good condition.
- Standard cleaning, already included in the rental fee, or charged separately where ordinary cleaning methods will not work.
(c) You may pay through the channels shown on our website: bank transfer, PromptPay, credit or debit card, or cash at the shop. You may also pay for all or part of your order with a promotional voucher under clause 11.
(d) Where you pay by credit or debit card, your card details are encrypted and processed by a compliant payment provider to reduce the risk of unauthorised access. We request a pre-authorisation on your card to confirm sufficient funds; the order is not confirmed until that check completes. If we do not receive confirmation from your card issuer, we accept no liability for delay in delivery or for non-delivery.
(e) By clicking "confirm booking" or "order", you confirm that the card or account used is yours or that you are entitled to use it, and that sufficient funds or credit are available.
(f) We are under no obligation to fulfil your order where the price shown on the website was incorrect, even if we have already confirmed the order.
5.5 Errors in an order
If you find an error in your booking or order after submitting it, please contact us at elinadressrent@gmail.com or on 0919828888 during opening hours as soon as possible. We will do our best to act on your request.
5.6 Refusing an order
We may withdraw any goods from this website and remove or change any information or content on it at any time. We will do our best to fulfil every order, but there may be circumstances in which we have to refuse one even after sending you a confirmation — for example, the gown was damaged on a previous rental and is no longer serviceable, or a system error caused a double booking.
If we cancel your order and you have already paid, we refund the full amount you paid, and where possible we will offer you a comparable gown instead. We are not liable for any loss beyond that refund.

Delivery and collection
6.1 We aim to deliver the goods to you at the place and on the date stated in the booking confirmation. You may collect the gown from the shop yourself, or have it delivered through the channels we specify — EMS, Kerry, Grab, Lalamove and the like.
6.2 We recommend choosing a collection date 1–2 days before the day you actually need the gown, so there is time to check it and resolve anything that comes up. We will tell you if we cannot deliver within the stated time. To the extent the law allows, we are not liable for loss caused by delivery delays attributable to an external courier or to force majeure under clause 16.
6.3 On receiving the goods you must sign for delivery, and you should inspect the gown straight away. If you find a mistake, a defect or damage, please tell us on 0919828888 or at elinadressrent@gmail.com immediately on receipt, with photographs. Otherwise the gown is treated as having been delivered complete and in good condition.
6.4 We may be unable to deliver to some areas. Where that happens we will contact you on the details you gave us, and either cancel the order with a full refund or deliver to an alternative address you provide.
6.5 We deliver the goods in the shop’s standard packaging. You must keep the garment bag, hanger, box and all accompanying items to return with the gown. If you want special packaging, you agree to pay the additional cost.
6.6 Risk in the gown passes to you as soon as you take delivery and stays with you until we receive it back under clause 7 — unless delivery was delayed by your own breach, in which case risk passes on the date delivery should have taken place.
6.7 If you are not able to take delivery, we may arrange a new delivery slot or ask you to collect from the courier yourself.
6.8 If delivery or collection is delayed because you unreasonably refuse to take delivery, or you do not take delivery within three (3) days of the first delivery attempt, we may (without prejudice to any other right or remedy):
(a) charge a reasonable fee or the costs incurred; or
(b) cancel the delivery and notify you immediately that the contract is cancelled, in which case we refund what you have paid, less a reasonable amount for our costs (including the cost of attempting delivery and returning the goods).
6.9 You accept that the gowns we rent are standard ready-made garments, not made up specially to your requirements or specifications.

Rental period and return
7.1 The standard rental periods are 1 day, 3 days and 5 days from the day you collect the gown, unless otherwise agreed and stated in the booking confirmation.
7.2 You must return the gown with all accompanying items by the due date, either by bringing it back to the shop during opening hours or by returning it by post or express courier, with the return cost borne by you.
7.3 Late return. If you return the gown after the due date, we charge a late fee of 500 baht per day per gown, from the day after the due date until the day we receive it back. We deduct this from the deposit first; where the fee exceeds the deposit, you agree to pay the balance.
7.4 If you do not return the gown within 5 days of the due date and we cannot reach you, we treat the gown as lost, and you agree to pay damages equal to its replacement value as stated in the booking confirmation, less the deposit you placed. We reserve the right to take whatever legal action we consider appropriate.
7.5 You may ask to extend the rental period by telling us at least 1 day before the due date. Extension depends on that gown’s booking schedule and attracts an additional rental fee.

Care of the gown, damage and cleaning
8.1 Throughout the rental period the gown remains the property of Elina Dress. You have only the right to possess and use it for its ordinary purpose. You must not sub-let, sell, pawn, lend or transfer any interest in the gown to anyone else.
8.2 You must look after the gown with the care a reasonable person takes over their own property, and must not wash, iron, steam or clean it yourself. We handle cleaning after every return.
8.3 Damage treated as ordinary wear — light marks that come out through the normal cleaning process, or a few loose threads that can be repaired straight away — is not charged to you.
8.4 Damage you are responsible for includes tears, burns, permanent marks that will not wash out (wine, deeply set make-up, paint), loss of beads, sequins, buttons or trim, unauthorised alteration, and loss of the gown or its accompanying items.
In such cases we assess the actual loss and tell you, with photographs, within 3 business days of receiving the gown back, on the following basis:
- Repairable damage: charged at the actual repair cost, capped at the replacement value of the gown.
- Damage beyond repair, or a lost gown: charged at the replacement value of the gown.
- Marks requiring a specialist cleaning process: charged at the actual cost the cleaner charges us.
8.5 We deduct the damages from the deposit first and refund the balance to you. Where the damages exceed the deposit, you agree to pay the excess within 3 days of being notified.
8.6 If you disagree with our assessment, you may dispute it immediately on being notified. We keep the damaged gown for 7 days so it can be inspected jointly.

Cancellation and postponement by the customer
9.1 If you wish to cancel or postpone a booking, please contact us on 0919828888 or at elinadressrent@gmail.com as soon as possible. The cancellation policy is:

9.2 You may postpone the date of use once, with at least 2 days’ notice, subject to that gown’s availability. If the gown is not free on the date you want, we will offer a comparable one or apply the cancellation policy in clause 9.1.
9.3 The deposit (damage security) is always refunded in full where you cancel before collecting the gown, unless costs have already been genuinely incurred on dispatch.
9.4 Refunds are processed within 7–14 business days of our approving the request, through the same channel you used to pay, unless otherwise agreed. How long the money takes to reach your account depends on your bank or card provider.

Defective goods
10.1 The product descriptions and information posted on this website are provided "as is", without warranty express or implied, beyond what the law requires.
10.2 Product photographs on the website may differ slightly from the actual item, particularly in shade, which can vary with your screen settings. The gowns we rent have been worn before and so may carry ordinary signs of use that do not affect their overall appearance.
10.3 If the gown you receive is significantly defective, please contact us at elinadressrent@gmail.com with your booking number, your name and address, the details of the item, the reason, and photographs, within the time set out in clause 6.3.
10.4 On being notified we will consider the matter and offer you options as quickly as we can: a comparable replacement gown, a reduction in the rental fee, or a full refund.
10.5 Where inspection shows the returned item is not defective, we may at our discretion refuse a replacement or refund, and may ask you to pay a reasonable amount towards shipping.

Promotional vouchers
11.1 You may use a promotional voucher towards goods or a rental on this website, on the terms printed on each voucher.
11.2 Promotional vouchers are valid only within the stated period, may be used once, and cannot be combined with another voucher or promotion unless stated otherwise. We may exclude certain items from a promotion at our discretion.
11.3 If your order is worth less than the voucher, the balance is neither refunded nor credited. Voucher credit does not bear interest and cannot be exchanged for cash.
11.4 If the voucher does not cover your order, you may pay the difference by any other payment method we accept.
11.5 In cases of fraud, dishonesty or suspected unlawful activity involving a voucher, we may close your account and/or require you to pay by another method.
11.6 We accept no liability for the loss, theft or unauthorised use of a voucher, and may suspend or cancel vouchers already issued at our sole discretion.

Disclaimer
12.1 The content on this website is provided without warranty as to its accuracy. To the fullest extent the law allows, Elina Dress, our partners, content providers and advertisers are not liable for any loss — including direct, indirect, special, consequential or incidental loss, or loss of use, profit, data, goodwill or reputation — arising out of or in connection with the use of, inability to use, or failure of this website.
12.2 To the extent the law allows, our total aggregate liability under any one contract does not exceed the amount you paid us for that booking or order.
12.3 Nothing in these terms excludes or limits the liability of Elina Dress for death or personal injury caused by our negligence, for fraud, for fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Indemnity
You agree to indemnify, defend and hold harmless Elina Dress, our directors, officers, employees, consultants and agents from any third-party claim, liability, damages and/or cost (including without limitation legal fees) arising from your use of this website or your breach of these terms.
14
Warranty and complaints handling
14.1 Elina Dress will perform our obligations under these terms with reasonable skill and care.
14.2 Customer satisfaction matters a great deal to us. You may contact us at any time on the details given above, and we will try to resolve your concern as quickly as we can.
14.3 If you wish to complain, please set out the details as clearly as you can and attach a copy of the booking or the booking number. In rare cases your email may land in our spam filter; if you have had no reply within five (5) business days, please send your question or complaint again.

Personal data protection
The collection, use and disclosure of your personal data is governed by our privacy policy, which forms part of these terms, and by the Personal Data Protection Act B.E. 2562. Please see the privacy policy page for the details.
16
Force majeure
16.1 We are not liable to you for any failure, interruption or delay in performing the contract caused by events beyond our reasonable control, including without limitation:
(a) strikes, lock-outs or other industrial action;
(b) civil unrest, riot, terrorism or the threat of terrorism, war or preparation for war;
(c) fire, explosion, storm, flood, earthquake, landslide, epidemic or other natural disaster;
(d) the unavailability of rail, air, road or other transport;
(e) the unavailability of public or private telecommunications networks;
(f) any law, decree, regulation or restriction of a government authority.
16.2 Where a force majeure event continues for more than one week, either you or we may terminate the contract with no liability other than refunding the price or rental fee you have paid for goods not yet delivered.
16.3 Where we have contracted to rent the same or similar goods to more than one customer and a force majeure event prevents us from meeting all of those obligations, we may decide at our sole discretion which contracts to perform and to what extent.

Notices
Any notice under the contract must be in writing and sent by post or email to the relevant party at the last address or email address known to the other party.
(a) A notice sent by post is deemed served two (2) business days after the time of posting to an address within Thailand.
(b) A notice sent by email is deemed served within two (2) business days of the time the email was sent.

Intellectual property
18.1 All content on or published through our website — including without limitation text, graphics, logos, trade marks, service marks, button icons, images, product photographs, video clips and campaign names — is the property of Elina Dress or our content providers and is protected by copyright law. You may store, print and display that content for personal use only. You must not publish, distribute or reproduce it in any form, and must not use it in any business or commercial venture.
18.2 The graphics, logos, page headers and service names on this website are trade marks of Elina Dress. They must not be used in connection with any product or service not supplied by Elina Dress in a way likely to confuse customers, or in a way that brings Elina Dress into disrepute. Other trade marks appearing on this website belong to their respective owners.
18.3 If you print, copy or download any part of the website in breach of these terms, your right to use the website ends immediately, and we may require you to return or destroy any copies you made.

Linking to the website
19.1 You may link to our home page, provided you do so lawfully, do not damage our reputation, and do not create a link suggesting an association, approval or endorsement that does not exist.
19.2 You must not link from a website you do not own, and must not frame this website within another. We reserve the right to withdraw linking permission without notice.

Waiver
Our failure to exercise, or delay in exercising, any right under these terms or the contract is not a waiver of that right and does not affect any other right or remedy we have.

Severability
If any provision of these terms or of the contract is held void or unenforceable by a court of competent jurisdiction, that does not affect the remaining provisions, which continue in full force.

Assignment
You must not assign, mortgage, sub-contract, encumber or otherwise dispose of these terms or the contract, or any right or obligation under them.

Relationship of the parties
Nothing in these terms or the contract creates or is deemed to create a partnership, an agency, or an employer-and-employee relationship between you and us.

Third-party rights
A person who is not a party to these terms has no right to claim or benefit under them.
25
Governing law
These terms and any contract (including non-contractual obligations arising out of or in connection with them) are governed by and construed in accordance with the law of the Kingdom of Thailand. You and we both submit to the jurisdiction of the Thai courts. Communication between us will be in Thai or English.

Amendments
We reserve the right to amend these terms at any time. Amendments are published on the website. Continuing to use the website constitutes acceptance of the amended terms. When you place a booking or an order, you agree that you do so under the terms current on the date you place it. It is your responsibility to review the latest terms each time you place an order.
